OVERVIEW

These Terms of Service (“Terms”) govern your access to and use of https://www.pinksalthimalaya.com (the “Site”) and any purchase from Pink Salt Himalaya (“we,” “us,” or “our”). By visiting the Site, submitting information, or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, do not use the Site.

Our store is hosted on Shopify, which provides the ecommerce platform that enables us to offer products and services.

1. ELIGIBILITY AND LAWFUL USE

You must be legally capable of entering into a binding agreement in your jurisdiction or use the Site with the permission and supervision required by law. You may use the Site only for lawful purposes and may not transmit malicious code, interfere with security, scrape the Site in a manner that disrupts service, commit fraud, infringe another party’s rights, or use our products or content for an unlawful purpose.

2. PRODUCT INFORMATION AND NATURAL MATERIALS

We try to present products, dimensions, colors, specifications, quantities, and photographs accurately. Screen settings, lighting, photography, and natural variation may affect appearance.

Himalayan salt is a natural mineral. Color, translucency, veining, texture, mineral pattern, and minor dimensional or edge variation are expected. Unless expressly stated otherwise, photographs are representative and do not promise an exact match between pieces or batches.

We may update product descriptions, packaging, specifications, or availability when reasonably necessary, provided that doing so does not unlawfully reduce rights attached to an existing order.

3. PRICES, PAYMENT, AND ERRORS

Prices and promotions may change without notice before an order is accepted. Taxes, shipping, freight, customs charges, and other applicable costs may be added and displayed at checkout or quoted separately.

You agree to provide current, complete, and accurate billing, payment, contact, and shipping information. Payment is subject to authorization and fraud screening by payment providers.

We may correct typographical errors, inaccurate descriptions, or obvious pricing mistakes. If an error affects an order already placed, we will contact you with appropriate options, which may include confirming the corrected order or cancelling it for a full refund.

4. ORDERS, AVAILABILITY, AND CANCELLATION

An order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it. We may reasonably limit quantities or decline or cancel an order because of inventory, shipping restrictions, suspected fraud, an obvious error, inability to fulfill, or another lawful reason. If we cancel after collecting payment, we will refund the cancelled amount.

Cancellation requests are not guaranteed after processing, production, procurement, packing, or shipment begins. Custom and special-order products may become non-cancellable once work or procurement has started.

6. INSTALLATION, SITE CONDITIONS, AND SAFETY

Salt walls, panels, tiles, bricks, blocks, lighting, electrical parts, adhesives, and heavy products must be selected, handled, installed, and maintained appropriately. Product descriptions and general guidance on the Site are informational and are not architectural, structural, electrical, engineering, code-compliance, or medical advice.

Before installation, verify dimensions, quantities, substrate condition, moisture exposure, ventilation, structural capacity, electrical requirements, fire and building codes, and the suitability of all materials for the intended environment. Use qualified professionals where appropriate. Follow product instructions and applicable laws and codes. We are not responsible for damage caused by improper storage, handling, cutting, installation, wiring, maintenance, site conditions, incompatible materials, or use contrary to instructions, except where liability cannot legally be excluded.

7. WELLNESS AND HEALTH INFORMATION

Statements about ambiance, relaxation, wellness, or traditional uses are general information and are not medical advice. Our products are not offered to diagnose, treat, cure, or prevent disease. Consult an appropriate healthcare professional regarding a medical condition, allergy, sensitivity, pregnancy, or safe use of a wellness or personal-contact product.

The Site may use or link to services provided by Shopify, payment processors, carriers, social platforms, and other third parties. Their separate terms and privacy practices may apply. 9. INTELLECTUAL PROPERTY

The Site and its original text, graphics, photographs, logos, designs, layout, and other content are owned by or licensed to Pink Salt Himalaya and are protected by applicable intellectual-property laws. You may view and use the Site for personal shopping and other lawful, non-commercial purposes. You may not reproduce, publish, sell, modify, or commercially exploit protected content without written permission.

10. REVIEWS, FEEDBACK, AND USER CONTENT

If you submit a review, photograph, comment, idea, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating and promoting our business, subject to our Privacy Policy and applicable law. We may moderate or remove unlawful, abusive, deceptive, or infringing content.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Pink Salt Himalaya and its owners, personnel, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from use of the Site or products.

Where liability may legally be limited, our aggregate liability relating to a product or order will not exceed the amount paid for the product or order giving rise to the claim. These limitations do not apply to fraud, willful misconduct, personal injury caused by negligence where exclusion is prohibited, or any other liability that applicable law does not allow us to exclude or limit.

14. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Pink Salt Himalaya against third-party claims, losses, or reasonable costs resulting from your unlawful misuse of the Site, your infringement of another party’s rights, or your material breach of these Terms. This section does not require a consumer to indemnify us for our own unlawful conduct or negligence.

15. GOVERNING LAW AND DISPUTES

These Terms and disputes relating to them are governed by the laws of Canada, without unlawfully limiting any mandatory consumer rights in the customer’s place of residence. The courts located in Canada will have jurisdiction, except where applicable law permits or requires another forum.

We may update these Terms by posting a revised version and changing the “Last updated” date. Changes apply prospectively unless applicable law allows otherwise. The Terms in effect when an order is placed will generally govern that order.

If any provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision is not a waiver. These Terms and the policies incorporated into them form the agreement concerning use of the Site and purchases, except for additional written terms expressly agreed for a particular order.
